Acceptance

Connecting a wallet and signing the acceptance message is agreement to these terms. Using this site, or interacting with any pool created through it, is also agreement to these terms, whether or not you signed. Acceptance is per wallet, for the version dated above. When the version changes, the launch wizard asks that wallet to sign again; an older signature does not carry over. If you do not agree to every clause below, do not use this software.

What this is, and what it is not

Open Gacha Protocol is BETA software: an open, permissionless Solana program plus this interface, provided AS IS and AS AVAILABLE, with no warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The program is unaudited. Features may change or break, off-chain services may pause or end, and cached data may reset, at any time, without notice.

NFW publishes software and operates optional supporting infrastructure. NFW is NOT a party to any pool, any pull, or any transaction between creators and their users. NFW is not a marketplace operator of your pool, not a custodian, not a broker, not a payment processor, and not your counterparty. Every transaction settles on the Solana blockchain between your wallet and the program.

Creators are in charge, and creators are responsible

The wallet that launches a pool becomes its on-chain authority and its sole operator. You, the creator, decide what your pool contains, who it admits, how it is priced, and where it is promoted. You are the merchant of record for your pool. NFW does not review, endorse, or control your pool's contents and has no ability to move the assets inside it.

Responsibility follows control. You alone are responsible for: the rights to every NFT and collection you admit; the truth of every claim you make about them; the legality of operating a chance-based product in every jurisdiction you offer it; any registration, licence, or age restriction that legality requires; refunds or disputes with your own users; and every tax consequence of your pool's revenue, anywhere it arises.

NFW never holds your keys and cannot recover, replace, or override them. Losing the key means losing the pool. For anything that matters, use a hardware wallet.

Your laws are your problem: jurisdiction and restrictions

Gacha, loot-box, and other chance-based mechanics are regulated as gambling, gaming, or prize promotion in many countries and in some states and provinces. Digital assets are themselves restricted or banned in others. It is YOUR obligation, before creating a pool or making a single pull, to confirm that doing so is lawful where you are, where your users are, and anywhere else a regulator could reach you. NFW makes no representation that this software is lawful or appropriate in any particular place.

You may not use this software if: you are under 18, or under the age of majority where you live; chance-based products like this are unlawful for you; you are located in, organised in, or acting for a jurisdiction subject to comprehensive sanctions; or you appear on any sanctions list, including the U.S. OFAC SDN list, or act for anyone who does. You may not use VPNs or other means to disguise your location for the purpose of evading these restrictions.

Fees, stated plainly

The protocol keeps a share of pool fees, enforced by the program at claim time. The default is 25%. Choosing the listed tier sets it to 50% at launch. The protocol authority can retune any pool's share at any time, in either direction, with no floor and no ceiling below 100%; every change is an on-chain event anyone can watch. A protocol-set minimum applies to the pool fee rate itself. Continued use after a change is acceptance of it.

Listing and off-chain services are discretionary

Indexing a pool on nfw.fun follows a manual review, and can be granted, refused, or removed at NFW's sole discretion, with or without cause or notice. The same is true of every off-chain service NFW runs: fulfilment bots, data mirrors, activity feeds, art hosting, and this interface itself. NFW may stop serving any pool, wallet, or region at any time. Because the program is permissionless, your pool keeps working on-chain without NFW; liveness of NFW's conveniences is never guaranteed and never owed.

Listing changes where a pool is promoted, never who owns or operates it.

Risks you accept

You accept, without limitation: smart contract bugs, including ones that lose assets permanently; blockchain outages, forks, and congestion; oracle (VRF) failure or delay; wallet and key compromise; NFT issuers with retained on-chain powers over their own assets; price volatility of SOL and of every asset in every pool; and the finality of on-chain transactions, which nobody, including NFW, can reverse. Randomized outcomes mean you can receive items worth less, including far less, than you paid. Nothing here is financial, legal, or tax advice; nothing is an offer of securities; past pool performance means nothing.

No liability, and your indemnity

To the maximum extent the law allows: NFW, its contributors, and its operators are not liable for any loss arising from this software or any pool, whether direct, indirect, incidental, consequential, special, or exemplary, including lost assets, lost profits, and lost data, under any theory, even if advised of the possibility. Where a court refuses to allow zero, total aggregate liability is capped at the greater of 100 USD or the protocol fees NFW actually received from the specific pool concerned in the three months before the claim.

You will defend and indemnify NFW, its contributors, and its operators against every claim, demand, fine, or proceeding, including reasonable legal fees, arising from your pool, your pulls, your breach of these terms, or your violation of any law or third-party right, including intellectual-property and gambling-law claims brought by your users or any authority.

Housekeeping

If any clause is unenforceable, the rest stand. These terms are the entire agreement about this software and replace every earlier version. NFW may update them at any time by publishing a new version here; the wizard will require a fresh signature before the next launch, and continued use is acceptance. A failure to enforce a clause today is not a waiver of it tomorrow.
